Major League Baseball sues trading card company Upper Deck

NEW YORK (Reuters) – Major League Baseball has sued Upper Deck Co, accusing it of trademark infringement for using its logos on trading cards without permission.

The lawsuit was filed six months after the sport awarded rival Topps Co a multi-year agreement to become its exclusive trading card maker. Topps has sold baseball cards since 1952.

Upper Deck had no immediate comment on the lawsuit, which was filed in Manhattan federal court. The company is based in Carlsbad, California.

In its complaint, Major League Baseball said Upper Deck has distributed unauthorized "Signature Stars" and "Ultimate Collection" lines of trading cards, and "is on the verge" of distributing several other unauthorized card lines.

It said Upper Deck's cards improperly feature various sport and team logos, and that some 2010 packaging featuring New York Yankee shortstop Derek Jeter may confuse consumers because of its similarity to authorized packaging used in 2009.

"Upper Deck's current conduct is reflective of a pattern of utter disrespect for the contractual and intellectual property rights of those from whom it licenses valuable trademarks," the complaint said. The company remains in default of more than $2.4 million it owes Major League Baseball, it added.

Major League Baseball seeks to halt sales of unauthorized cards, and also seeks triple and punitive damages.

Topps last year settled a lawsuit in which it accused Upper Deck Co of stealing its designs for baseball cards. Terms of that settlement were not disclosed.

Based in New York, Topps was bought in 2007 by former Walt Disney Co chief Michael Eisner's Tornante Co and private equity firm Madison Dearborn Partners LLC.

The case is Major League Baseball Properties Inc v. Upper Deck Co, U.S. District Court, Southern District of New York, No. 10-732.

This doesnt even include panini which usually DOES come out on the original release date. I don't know about you but this is an awful lot of product to absorb in such a short span. While it's great to see new products coming out, the spacing can be a hell of alot better, a couple of these products were supposed to be out for the holidays and have been delayed till now. Hopefully some of these products were delayed to cut down on the dreaded redemptions and will provide some bang for the buck. We have all these releases available for preorder on the website. Trading card company to provide autographs and game-used memorabilia cards of baseball’s all-time hits king inside upcoming lineup of products



Carlsbad, CA (January 6, 2010) – Pete Rose, one of baseball’s most colorful and revered players and managers, has just signed an autograph deal with The Upper Deck Company. Due in part to Rose’s roller-coaster ride with baseball officials, his autographed cards remain in high demand and Upper Deck officials are ecstatic to have the all-time hits leader (4,256) on board for its 2010 baseball releases.



“Despite his current ban from baseball, Pete Rose’s signature and game-used memorabilia cards continue to be sought-after by baseball fans and card collectors everywhere,” said Gabriel Garcia, Upper Deck’s baseball brand manager. “We are extremely excited to have Pete be a part of our newest baseball card releases.”



Rose, who finished his 24-year playing career in 1986 with a lifetime bating average of .303, was the 1963 NL Rookie of the Year as well as the league’s MVP in 1973. A 17-time All-Star selection, Rose was also named MVP of the 1975 Fall Classic when he batted .370. He concluded his illustrious career on the baseball diamond with three championship rings to his credit.



The first Upper Deck product that will include Rose’s game-used memorabilia cards is 2010 Goudey Baseball, which is scheduled to hit store shelves on March 18.
